Sending a Legal Notice
To send a legal notice, you must hire a lawyer with specialization in the field of divorce and/or family law from Adarsh Singhal and Its Associates. You should discuss the case with the lawyer so that they can draft a legal notice addressing the issues you have with your spouse for which you want a divorce.
Usually, legal notices are sent in English; however, they can also be sent in the regional language.
After the lawyer drafts the notice, they will sign it and send it to the concerned party through courier, speed post, or registered post. The acknowledgment of receipt is kept, and the lawyer also retains one copy of the legal notice.
The legal notice must contain:
- Clear reasons for sending the notice
- Previous communication regarding the cause of the notice
- A reasonable time period for the recipient of the notice to reply or take action as desired by the sender
Replying to a Legal Notice
The party receiving the legal notice must reply within the time mentioned in the notice. If the party fails to respond within this time, the sender of the notice can proceed with the actions mentioned in the notice.
If the party replies within the stated time, the sender can either settle the matter out of court and resolve the dispute (in this case, the divorce issue) or file a petition in court for divorce. It may also occur that both parties agree to the divorce, and the divorce is granted through mutual consent.
